END USER LICENSE AGREEMENT

1. General

1.1 This End User License Agreement (hereinafter “EULA”) forms the contractual basis between you (hereinafter “Licensee”) and Eduard Telik (hereinafter “Licensor”) for the use of the software produced by the Licensor including associated media, documentation (e.g. program descriptions, instructions for use) and other documents and materials (hereinafter “product(s)”).

1.2 By using the product you agree to this license agreement. If you do not agree to this license agreement, you are not authorized to download or use the product.

2. Scope of Use

2.1 Licensor’s product is legally protected. The intellectual property of the product provided to the licensee belongs and remains with the licensor. The licensee only receives the right to use the product to the following extent. All other acts of use and exploitation that are not expressly granted to the licensee in this EULA are not permitted without the written consent of the licensor. In particular, the licensee is not entitled to break down the product or its parts, to have it broken down, to technically trace it back or to arrange for technical traceability. The licensee is obliged to take suitable and appropriate measures to ensure that third parties, including its own employees, cannot use and exploit the product received from the licensor without authorization. Licensee shall be liable to Licensor for any loss or damage in connection therewith.

2.2 The licensee receives a non-exclusive, temporally and spatially unrestricted right to use the provided product. The licensor is not obliged to provide the source code on which the product is based, including the associated development documentation.

2.3 The licensee is entitled to install and use the licensed product on an unlimited number of devices. The licensee is entitled to reproduce the product provided insofar as the respective reproduction is necessary for the contractually agreed use. Licensee is entitled to make a backup copy if this is necessary to secure future use. The licensee is not entitled to edit the product, except to preserve or restore the agreed functionalities of the purchased product.

2.4 The licensee is entitled to transfer the product to a third party, provided that the third party expressly agrees to these license terms.

3. Sound License Agreement 

The samples, instruments and presets provided may be used for commercial and non-commercial music and audio productions in accordance with the provisions of the present agreement without the prior consent of the licensor on a case-by-case basis. The use of this product (particularly the samples, the instruments and the presets) to create a sound library or as a sound library for any type of synthesizer, virtual instrument, sample library, sample-based product or other musical instrument is strictly forbidden. Individual samples, sound sets or audio loops may not be separately distributed (commercially or otherwise). In addition, such samples, sound sets, or audio content may not be repackaged in whole or in part as audio samples, sound libraries, or sound effects. 4. Protection Duties

Copyright notices and other features serving to identify the program may not be removed from the product or changed.

5. Final Provisions

If a provision of this license agreement is or becomes invalid, either in whole or in part, this fact has no influence on the remaining provisions. Instead, the parties undertake to replace the ineffective provision with an effective provision that comes as close as possible to the meaning of the original provision.

Some content or software components that are part of the licensor’s software products represent the intellectual property of third parties:

The KONTAKT software is owned by Native Instruments GmbH.

The logo of the Detmold University of Music and the Erich Thienhaus Institute are owned by the Detmold University of Music.

The Hochschule für Musik Detmold is a public body with legal capacity, supported by the state of North Rhine-Westphalia, Germany.
